Does the size of the groups make a difference? Consider this variant of the position, a modified version of what Fairbairn shows:

I think that, even with a rule set that would consider the left group live or seki, B can kill it if he is willing to sacrifice the group on the right. Assuming such a rule set and a large enough W group on the left, can B insist on playing it out that way?

Sure. The black group dying is worth around 12 points, so white's ko threat is not sufficient to be answered.
